Story of the sale : A successful sale in Nice for customers from Alsace.

This sale began with the request of an Alsatian couple looking for their ideal pied-à-terre in Nice: an apartment with sea view, at least two bedrooms (or even three), a large terrace and a quiet and green environment, while remaining close to amenities. In short, not easy because Nice does not often offer all these criteria at the same time.

Our real estate agency in Nice has organised five targeted visits to help them discover the neighbourhoods best suited to their needs. After reflection and study of the documents, the clients made a well-negotiated offer, accepted by the sellers due to the absence of a financing clause. The property found is a kind of villa apartment on the top floor of nearly 100m2 totally and very qualitatively renovated with a terrace of 40m2 and a breathtaking sea view while remaining quiet and close to a bakery, and two restaurants, and even on foot, a few minutes from the tramway.

The sales agreement was signed quickly, with two notaries, one in Alsace and the other in Mougins. The period between the preliminary agreement and the signing was devoted to providing the necessary information to the buyers.

A difficulty has arisen concerning the original plans of the co-ownership, which are often difficult to obtain because it must be understood that the plans that are supposed to be annexed to the co-ownership regulations and to the descriptive statement of the original division, most often archived by notaries, end up disappearing probably by dint of transfers of archives. After several steps, the plans were finally obtained, thus satisfying the buyers.

However, a waterproofing problem on the terrace was discovered a few days before the signing of the final deed. This discovery has raised legitimate concerns among buyers.

An exemplary collaboration between the two real estate agencies (whom I would like to thank) has made it possible to bring together all the stakeholders: property manager, notaries, agencies, seller and buyer. A solution was found thanks to the listening of the seller, who accepted a reduction in the sale price to compensate for the risk related to the waterproofing problem which theoretically and according to the regulations and the syndic exchanges is a common part with private use, and therefore the work will be paid for by the entire co-ownership, but in doubt, legitimate property of the buyer and to avoid blocking the sale for the time of the General Assembly which would vote, or not, these works, the agreement is preferable.

The sale has finally been completed, and customers are delighted with their acquisition. This sale demonstrates the importance of rigour, communication and the ability to find compromises, even in the face of the unexpected.
